OT : Broadus to sue

Short blurb in the Gazette that Broadus is to sue SUNY for racial discrimination.

 

Multiple arrests, academic issues, possible payments to students, cover ups, recruiting violations, yup it's because you are black Kevin. Seriously? Please do not offer this loser any kind of settlement. They should go after money they've already paid him.

People are overly sensitive these days.

 

Take for example the Walmart prank that was in the news recently where someone dialed up the PA and said all black people must leave. Some black folks started saying they are going to boycott Walmart completely when it wasn't Walmart who made the announcement. Seriously?

This guy really is a total idiot. He references Coach Ford on the first page of his complaint as a white guy who didn't get punished when his players were charged with rape.... Huge difference where you have a well respected coach that has been at the school forever with very few issues vs. a coach with a history of recruiting issues and a team full of thugs that was a ticking time bomb.....

Coach Ford and Albany held the players responsible for the rape complaint accountable instead of enabling bad conduct and trying to cover it up like Bingo did how many times in his short tenure.

I find it interesting that Broadus has apparently filed this complaint himself. I'd be willing to bet he couldn't find a lawyer to do it for him on contingency.....which is a testimate to how terrible his case is.

PLease give me credit if you do post this on the AE board (I cannot figure out my password right now)...but how big of an idiot is Broadus; in his complaint he said he was the "AMERICAN EAST" Coach of the Year.

 

The moron (or the idiot who wrote this for him) doesn't even know the Conference name.

 

Not only that, his statement about Ford is absurd for many reasons, including that the Coach and McElroy suspended the players upon them being charged...and then permanently dismissed them on indictment. Those, are acts of leadership.

I agree. If he went away quietly and "started over" as an assistant somewhere I think he had a shot at returning as a coach. I think this will put him in a spot where no one will want to touch him. First the recruiting issues and then the NCAA violation (which was minor but still...) and then the complaint of racism. Oh and he also has a long entry on his website about his philosophy of giving kids a second chance. You would think after the way this worked out he would try to get away from that strategy. Instead he is touting the strategy. Someone posted on the AE site that you can have one second chance kid on a team full or honor roll athletes and things will most likely be fine but filling a team with second chance kids is a recipe for disaster.

While it would not be my suggested course of action for Broadus, I believe that the filing of the complaint is a strategic move by Broadus.

 

First, any discrimination claim filed with the NYS Division of Human Rights must be filed within one year of the accrural of that claim. Thus, it's a now-or-never-type situation. See NYS Division of Human Rights, FAQ

 

Second, the writing is on the wall for Broadus. He will not be returning as head coach at Binghamton (or anywhere?), given the recent report of J. Kaye. By filing this complaint, it is possible that he will seek or hope for a buy-out of his contract for his resignation and withdrawal of the complaint. Of course, from Bingo's perspective, they will try to void his contract in light of the recent report's findings.

 

Third, the fact that this may have been a strategic move and not an issue of discrimination is bolstered by the fact that he has been replaced (albeit temporarily) by another black coach (Macon). So, is his argument that he was discriminated against so that the school could replace him with another black coach (lol)? Obviously, on its face, there doesn't seem to be any indicia of racial discrimination.

 

Thus, I believe this is nothing more than a strategic move in anticipation of his dismissal. He's probably attempting to gain leverage to negotiate a buyout or save image (IMHO, the wrong move for Broadus to make) if nothing else. As stated, given that his interim replacement is black, charges of discrimination are indeed bizarre, and I suspect that he and his attorney, if he retained one, know this already. Ergo, Broadus is perhaps not an "idiot"; rather, it might be that he has considered this to be strategic move that might earn him a settlement to resign (or not). Keep in mind, a settlement could in the long run be far cheaper in terms of public image and money (i.e., attorneys' fees) than to litigate a discrimination claim in different legal fora.

 

It remains to be seen what happens, and I make no claim as to the viability of his strategy or its likely success (IMHO, it's a bad move in the long-run). If his coaching career is over, at least for the time being, this may be nothing more than a tactic to obtain whatever buyout or settlement he can get, for solely fiscal reasons.

 

 

 

Edit: Given that it appears Broadus filed his complaint pro se (handwritten complaint), it is quite possible that he considered none of the foregoing strategies, especially given his illadvised reference to UAlbany and Ford. Given the scrutiny he's under, this is the sort of situation that simply calls for humility.

That said, from working the litigation side of this type of stuff in my past life, he has NO CHANCE. In fact, if I am Bingo, I am now firmly entrenched and I hire a big firm to abuse the $iena out of him through the discovery process. Basically, they have the resources to break this guy to the point where he cant even afford this case. He should have taken whatever buyout there is.

 

Additionally, and this is a HUGE thing many are forgetting, it is one thing to file an EEO or Discrimination claim...it is another to libel someone. His website, arguably, is promoting extremely and knowingly false statements about Zimpher, Norris, et al. He is perilously close to libel, IMHO.

D96, I agree with you 100%. And you're right about the libel, etc., and you make an excellent point about the discovery process and resources. It would seem that his actions have not been under advisement of counsel. He's making all the wrong moves; he's gone off the reservation, as the saying goes.

Objection. This FOIL request is broad and unduly burdensome. Expenses for such would far exceed the intent of the FOIL Act. Notwithstanding the objection, please find attached a listing of all newspapers in the Albany, NY area. Further, please find attached a copy of the Educational Privacy Act, the Privacy Act of 1974, and _________ (I dont know the name of the newest NY privacy Act). Finally, in the 10 years of Division 1 sports sponsorship, Albany does not keep active records of arrests by non-University enforcement agencies. We refer you to those agencies to further answer your questions.
